FRIDA CLAIRE is entitled to store the personal data received within the scope of this business relationship and, if necessary, to pass them on to the relevant insurer and/or refinancing institution. FRIDA CLAIRE processes your data in order to process the contractual relationship between you and the Company.
Collection of data
The data is collected in particular when a contractual relationship is concluded (e.g. "Commission 50/xxx"). In order for Frida Claire to commission your production and to draw up and manage the relevant term contract, it needs your correct name, address and contact data (address, e-mail address and telephone number) so that Frida Claire can confirm the conclusion of the contract to you and communicate with you in the event of problems with the service you have commissioned.
Use of data
Frida Claire also uses the personal data for your identification in the dealer portal (customer login). Basis for the data processing is art. 6 para. 1 lit. b DSGVO, which allows the processing of data to fulfill a contract or pre-contractual measures. Frida Claire will also process your data if it is necessary to protect the legitimate interests of Frida Claire or third parties. This can in particular be the case to guarantee security or also in case of support requests, in order to be able to understand and prove facts in case of legal disputes. In addition, we process your data for the fulfilment of legal obligations (e.g. regulatory requirements, commercial and tax storage and verification obligations).
Frida Claire gives its customers the opportunity to purchase services and purchases using uncertain payment methods (e.g. instalment payment on credit). Companies that offer their customers insecure payment methods have a legitimate interest in protecting themselves as much as possible against the occurrence of payment defaults. This is done, among other things, by checking the creditworthiness of the respective customer before or during the granting of the possibility of using insecure payment methods. As part of this check, Frida Claire is entitled to obtain creditworthiness information from an external credit agency.
Order data in the dealer portal
The data you provide in the context of an order can be used by Frida Claire to check whether there is an atypical order process.
Transfer of data in the field of receivables management
If, despite repeated reminders, or in the case of regular installment payments even without reminder, you do not pay outstanding invoices/installments as agreed, Frida Claire may transmit the data required for the execution of a collection (name, address, e-mail address, details of the company and, if applicable, contract and claim data) to a collection service provider for the purpose of selling the outstanding receivables as well as for the purpose of collection and debt collection processing. If the outstanding receivables are sold, the latter then becomes the owner of the receivable and asserts the receivable in his own name.
Forwarding of data to third parties
Your personal data will only be passed on to third parties or otherwise transmitted if this is necessary for the purpose of contract processing or billing or if you have given your prior consent or if there is a legal basis for the passing on of such data. Insofar as it is necessary for the purpose of contract processing or for the dispatch and delivery of products and premiums, data will be passed on to partner companies which have been commissioned to support contract processing. Frida Claire Partner companies undertake to comply with and observe the data protection regulations. Frida Claire Partner companies are not permitted to use the data for any other purpose than the execution of the contract.
In principle, Frida Claire will delete your data as soon as they are no longer required for the above purposes, unless temporary storage is still necessary. Frida Claire, for example, stores your data in accordance with legal obligations to provide evidence and to retain it, which arise, among other things, from the Commercial Code and the Tax Code. The storage periods are then up to ten full years. In addition, Frida Claire keeps your data for the period during which claims can be made against the company (statutory limitation period of three or up to thirty years).

Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of the data processing and, if applicable, a right to correction, blocking or deletion (as long as this makes it possible for FRIDA CLAIRE to process the contractual relationship in full) of this data.
